Savoy, 65 M.J. 854, A.F.Ct.Crim.App.,(2007.) the court stated that pretrial confinement review officer (PCRO) did not abuse his discretion in determining that accused’s pretrial confinement should be continued, where, faced with a court-martial for drug use, accused went on a month-long spree of substance abuse, disrespect for authority, and self-destructive behavior; accused’s actions reasonably led to conclusion by PCRO that it was foreseeable accused would continue to engage in serious criminal misconduct, that she might not appear at trial, and that lesser forms of restraint would be inadequate.

Miller, 65 M.J. 845, A.F.Ct.Crim.App.,(2007.) the court stated that evidence was legally and factually sufficient to support findings of guilty to one specification of attempting to take indecent liberties with a child, and two specifications of attempting to communicate indecent language to a child under the age of 16, arising from internet encounter with police detective posing as a 14-year-old girl in sting operation; although accused contended that entire internet encounter was simply part of a “fantasy world where participants routinely lie about the most basic personal information,” evidence supported military judge’s conclusion that accused truly believed the “girl” was 14 years old.

In U.S. v. Heitkamp, 65 M.J. 861, Army Ct.Crim.App.,(2007.) the court stated that accused’s plea of guilty to charge of wrongful possession of methandienone, an anabolic steroid, was not rendered improvident by his unsworn statement in which he suggested that he believed his possession of an anabolic steroid was not wrongful, as his statement did not raise defense of mistake of law or fact; accused’s knowledge of unlawfulness was not required and his lack of knowledge of the unlawfulness of the contraband was not a defense.
